You remain responsible for deciding whether to pursue an opportunity.

10. Invitations and Participation

You retain ownership of content that you own and submit to Popsity, subject to the rights you grant below.

By submitting content, you grant Rainminds a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, format, display, distribute, and otherwise use that content as reasonably necessary to operate, provide, improve, and promote the Services.

This license continues for as long as reasonably necessary for those purposes, subject to applicable law and our Privacy Policy.

You represent that:

You have the rights necessary to submit the content.
Your submission does not knowingly violate another person's rights.
Your submission does not knowingly contain unlawful or fraudulent material.
You are responsible for the accuracy of information you submit.

14. Prohibited Content

You must not submit or distribute content through Popsity that:

Is unlawful
Is fraudulent or intentionally deceptive
Impersonates another person or organization
Infringes intellectual property rights
Violates privacy or confidentiality obligations

18. User Decisions and Responsibility

However, you are responsible for your own decisions and actions.

Popsity does not decide whether you should pursue an opportunity, accept an invitation, provide information to a third party, register for an event, apply for a position, enter into a contract, make a payment, or take another action.

You should independently evaluate opportunities and third-party information before taking action.

19. Intellectual Property

The Popsity Services, including their software, design, branding, logos, user interface, documentation, technology, and other materials provided by Rainminds, are owned by or licensed to Rainminds and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not:

Modify the Services
Distribute the Services
Sell or sublicense the Services
Create derivative works from the Services
Remove proprietary notices
Use Popsity branding without authorization

Nothing in these Terms transfers ownership of Popsity or Rainminds intellectual property to you.

20. Popsity and Rainminds Branding

"Popsity" and related branding, logos, names, designs, and marks may be owned by or associated with Rainminds Solutions Private Limited.

You may not use Popsity or Rainminds trademarks, logos, or branding in a way that:

Implies an unauthorized partnership
Implies endorsement
Creates confusion about affiliation
Suggests authorization where none exists

Any permitted use must comply with applicable brand guidelines or written authorization.

Where a third party charges a fee, that transaction is between you and the relevant third party unless Popsity expressly states otherwise.

Popsity does not guarantee the pricing, refund policies, payment terms, or financial arrangements of third-party opportunity providers.

25. No Guarantee of Opportunity Outcomes

Popsity does not guarantee that using the Services will result in:

Employment
Admission
Funding
Business opportunities
Partnerships
Customers
Revenue
Professional advancement
Educational admission
Event participation
Any other particular outcome

The purpose of Popsity is to help users discover and pursue potentially relevant opportunities. Actual outcomes depend on factors outside Popsity's control, including decisions made by opportunity providers and other third parties.

26. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

To the extent permitted by law, Rainminds disclaims warranties, express or implied, relating to:

Completeness
Reliability
Fitness for a particular purpose
Non-infringement
Merchantability

Results obtained from using the Services

Nothing in these Terms excludes a warranty or legal right that cannot lawfully be excluded.

27. Limitation of Liability

To the maximum extent permitted by applicable law, Rainminds Solutions Private Limited and its directors, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to:

Decisions made based on recommendations or AI-generated information
Loss of data
Unauthorized access resulting from circumstances beyond our reasonable control

To the maximum extent permitted by applicable law, our aggregate liability arising from your use of the Services will be limited to the amount you paid to Rainminds for the relevant Services during the twelve months preceding the event giving rise to the claim.

Nothing in this section limits liability that cannot legally be limited or excluded under applicable law.

28. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Rainminds Solutions Private Limited and its directors, officers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

Your violation of these Terms
Your misuse of the Services
Your violation of applicable law
Your violation of another person's rights
Content you submit to Popsity
Your unauthorized use of the Services
Your interactions or transactions with third parties

This obligation does not apply to the extent that the claim results from our own unlawful conduct or other circumstances that cannot legally be excluded.

29. Suspension and Termination

We may suspend or terminate your access to some or all of the Services where reasonably necessary, including if:

You create a security risk

Your account presents a risk to Popsity or other users

Nothing in this section limits any mandatory consumer or other legal rights that cannot be excluded under applicable law.

The remaining provisions will continue to apply.

38. No Waiver
